Welcome to SI Furniture & Mattress. This Terms of Service Agreement ("Terms") governs your use of the website operated by SI Furniture & Mattress ("we," "us," or "our") and all services and products offered on the site.

SI Furniture & Mattress is a family-owned business specializing in the sale of luxury, high-end furniture, including living room, dining room, and bedroom sets, as well as a full range of mattresses and bedding.

1. Acceptance of Terms

By accessing or using our website, purchasing products, or engaging with our services, you agree to be bound by these Terms and all policies referenced herein, including our Return and Refund Policy. If you do not agree to these Terms, you may not use our services.

2. Products and Services

We make every effort to display the colors, descriptions, and images of our products as accurately as possible. However, we cannot guarantee that your device's display of any color will be accurate. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion.

• Pricing and Availability: All prices are listed in Canadian Dollars (CAD) and do not include applicable taxes or shipping charges, which will be calculated at checkout. We reserve the right to discontinue any product at any time.

• Product Quality: Our motto is to ensure that customers can feel the difference of the quality we provide for furniture with excellent pricing and customer service.

3. Orders, Billing, and Account Information

A. Order Acceptance

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.

B. Order Cancellation

You may cancel your order according to the terms outlined in Section 4 of our Return and Refund Policy. If the product has left our warehouse, deductions for shipping and return shipping charges will apply.

C. Accuracy of Information

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

4. Shipping, Delivery, and Risk of Loss

A. Shipping Coverage

We provide service to online furniture shoppers throughout Manitoba and all other provinces in Canada.

B. Inspection of Merchandise

Risk of loss and title for items purchased from SI Furniture & Mattress pass to you upon our delivery to the carrier. You are responsible for fully inspecting the merchandise upon delivery as detailed in our Return and Refund Policy.

• Damaged Shipments: As per our policy, you must check your merchandise and sign in the presence of the delivery company representative. If the product arrives in damaged condition, you must not accept delivery. Damage discovered after acceptance must be reported within 48 hours.

5. Returns and Exchanges

All returns and exchanges are governed by our separate Return and Refund Policy. By agreeing to these Terms of Service, you acknowledge and agree to the conditions set forth in that policy, including but not limited to the 14-day return window, non-returnable items (e.g., Mattresses, Custom-made items), and applicable restocking fees.

6. Intellectual Property

All content published on this website, including texts, graphics, logos, images, digital downloads, and data compilations, is the property of SI Furniture & Mattress or its content suppliers and protected by Canadian and international copyright laws. The technology and software supporting the online store are provided by third-party platforms, such as Shopify, and are subject to their respective terms and intellectual property rights. You may not use our intellectual property without our express written permission.

7. Limitation of Liability

In no case shall SI Furniture & Mattress, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.

8. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein, without regard to its conflict of laws principles.
